Terms and Conditions

By participating in the TVBAnywhere+ “TVB Anniversary Month – Prizes Giveaway!” (the “Campaign”), you agree that you have read these Terms and Conditions and that you accept and agree to be bound by them.

1. The Campaign is organised by TVB (Singapore) Pte Ltd (“TVBSG”). The Campaign commences on 8 November 2019 00:00 am and ends on 30 November 2019 11:59 pm (Singapore Time) (the “Campaign Period”). Eligible participants may submit entries during the Campaign Period and any late entries will not be accepted. TVBSG has the right to determine the submission time of entries based on its own records.

2. All participants (a) must be a TVBAnywhere+ Application eligible user with a user account registered in Singapore and subscribed to any of the TVBAnywhere+ Application premium services during the entire Campaign Period; and (b) must use their email addresses registered with TVBAnywhere+ Application for the participation.

3. All entries (a) must be within 100 Chinese/English words; (b) must be original; (c) must not consist of any inappropriate element, including but not limited to illegal, defamatory, abusive, profane, offending, sexual, commercial or harassing; and (d) must not infringe any rights (including intellectual property rights) of TVBSG and/or any third party. TVBSG reserves the right to remove any inappropriate content and/or disqualify any participants and entries without giving any reason.

4. All account user names of the participants and the entries may be made public and exploited by TVBSG and its affiliates for all purposes related to the Campaign without prior notice.

5. TVBSG will select best 7 entries among all eligible entries, based on creativity related to the designated theme, during the first week of December 2019. TVBSG’s decisions on the winning entries shall be final with no dispute or discussion allowed under any circumstances.

6. An eligible participant may submit an unlimited number of entries, but is not entitled to more than one winning entry. TVBSG has the right to disqualify any or all of the entries of any participant who is found to be using fraudulent, without prior notice

7. Campaign prizes (collectively, the “Prizes”):
• Best Entry x 2 winners (each for VIP category and VVIP category): vivo V17 Pro (Recommended Retail Price: S$ 599)
• 2nd Best Entry: vivo V11 (Recommended Retail Price: S$ 499)
• 3rd Best Entry: S$400 Shu Yan Sichuan Cuisine vouchers
• Consolation Prizes x 3 winners: S$200 Shu Yan Sichuan Cuisine vouchers
(collectively, the “Winners”)

Additional Prizes (For VVIPs only)
VVIPs refer to TVBAnywhere+ premium service(s) users who have been subscribing to the service(s) for the last consecutive 12 months, including those who are reaching their 12th month within the month of November 2019. The first 100 TVBAnywhere+ VVIPs who participate in the Campaign will be entitled to the following additional prizes:
• Cake voucher (with a value of S$ 6)
• 3-month premium services (both VOD Zone and Linear Channel Zone) access gift voucher one-time redeemable by any bearer with an email address not yet registered with TVBAnywhere+.

8. Only the Winners will be notified, by email on or before 31 December 2019. TVBSG has the right to decide the arrangement for redemption of Prizes and the Winners may need to present their identification documents for verification upon Prize collection in accordance with TVBSG’s instructions.

9. Winners who cannot be contacted or fail to provide the requested information within 2 weeks after first contact by TVBSG (via email) will be disqualified without further notice and TVBSG shall not be responsible for their losses. TVBSG reserves the right to redistribute any unclaimed Prizes to other participants or handle any unclaimed Prizes in any appropriate manner.

10. The email addresses provided by the participants at the point of registration to the TVBAnywhere+ Application and any information (including contact details) provided during the Campaign must be true, accurate and valid. TVBSG may disqualify any participant, refuse to award the Prizes or retrieve the Prizes that have been claimed or obtained if any information provided by him/her is found to be fraudulent, incorrect, incomplete, or in violation of these Terms and Conditions.

11. The Winners acknowledge and agree that (a) TVBSG shall not be deemed to be the producer, supplier or sponsor of the Prizes; (b) usage of the Prizes must be in accordance with the terms and conditions designated by the producer, supplier and/or sponsor; (c) the Prizes shall not be transferable, exchangeable, redeemable or substituted for cash or other benefits; and (d) TVBSG has the right to substitute the Prizes with other prizes of similar nature or value if for whatever reasons the original Prizes are not available.

12. To the fullest extent permitted by law, TVBSG and its affiliates expressly disclaim any liability for (a) any loss due to failure to complete the submission or loss of data resulting from technical problems; and (b) any damage, loss, cost, expense or other liability (including but not limited to tax) suffered or incurred by any person arising out of or in connection with the Campaign, the redemption, use and/or enjoyment of the Prizes. No warranty is given as to the suitability, quality or condition of the Prizes and/or any parts thereof. TVBSG, the producer, supplier or sponsor of the Prizes shall not be liable to replace or reissue the Prizes due to any loss, damage or robbery of the Prizes. The participants shall indemnify TVBSG and keep TVBSG indemnified of any damage, loss, cost, expense or other liability (including third party liability) suffered or incurred by TVBSG arising out of their participation in the Campaign.

13. Personal information collection statement: TVBSG may collect, use and retain participants’ personal data subject to Personal Data (Privacy) Ordinance and TVBSG Privacy Policy (https://www.tvbanywhere.com.sg/privacy.html). The personal data will only be used for the purpose of the Campaign, including verification of participants’ eligibility, announcement of Winners, redemption of Prizes and other ancillary purposes. Every reasonable effort will be made to safeguard the confidentiality of the personal data.

14. The Campaign is not organised, sponsored, supported or managed by Facebook or other media platforms.

15. For the sake of fairness, TVBSG’s employees and their immediate family members are not eligible to participate in the Campaign.

16. TVBSG reserves all rights of decision in relation to the Campaign (including but not limited to the right to cancel the Campaign, change the Campaign Period and/or amend these Terms and Conditions at any time and without notice). In the event of disputes, TVBSG’s decisions and interpretation in relation to every aspect of the Campaign shall be deemed final, conclusive and binding under any circumstance and no further appeal, enquiry and/or correspondence will be entertained.

18. The Campaign and these Terms and Conditions shall be governed by and construed in accordance with the laws of Hong Kong. The participants consent to the non-exclusive jurisdiction of the courts of Hong Kong in connection with any legal action that may arise in relation to the Campaign and these Terms and Conditions. The Contracts (Rights of Third Parties) Ordinance shall not apply to the terms and conditions herein. In case of any discrepancies between the English and Chinese versions of these Terms and Conditions, the English version shall prevail.
